Evisions Marketing Inc. ("EVISIONS") has published
this legal information in an effort to enhance
the use of the Internet by promoting responsible
use and in an effort to provide a reliable, high-quality
service to its customers. In regard, EVISIONS
requires its customers and other third-party
users (collectively, its "USERS") to utilize
our services, websites and networks responsibly
and in compliance with all applicable state laws
(within Arizona) and the terms of our privacy
page which applies to all active websites that
EVISIONS currently owns and operates.
Prohibited Conduct
USERS may not use EVISIONS services or websites
or networks (a) in violation of any applicable
local, state, or federal law or regulation; (b)
in a manner that infringes or may infringe upon
any copyrights, trademarks, patents, trade secrets,
or other types of intellectual property; (c)
to transmit offensive or threatening materials,
including materials that are obscene, pornographic,
defamatory, libelous, abusive, hateful, excessively
violent, or otherwise inappropriate; (d) to transmit
fraudulent, deceptive, or misleading materials
or to advance any type of financial scam; (e)
to transmit any materials that harass another
person or entity; or (f) to transmit viruses,
Trojan horses, or other materials harmful to
any network or equipment or other Users or third
parties.
Client Usage
USERS will be contacted by EVISIONS once a USER
has become a client to EVISIONS or any site owned
and operated by EVISIONS. USER will be notified
via e-mail of Order Invoice Information, Password
- Log In Information or any information that
must be sent to the USER in regards to account
status or update information. USER may discontinue
services at any time by contacting the appropriate
customer service e-mail or toll free number listed
off of the participating website that is owned
and operated by EVISIONS.
Site Updates And Down Time
EVISIONS will update and or modify USERS software
and or services. USERS may experience network
outages that are not controlled by EVISIONS.
EVISIONS may choose to reboot servers at any
time. The preceding may cause the USER to experience
down time, which may cause a delay in services
rendered. EVISIONS is not responsible or will
be held liable for damages in any form due to
the preceding as EVISIONS makes every effort
to ensure that USERS are able to use our services
effectively and in a timely manner.
System, Website and Network Security
USERS may not use EVISIONS services or websites
or network to violate or to attempt to violate
the security of any network, service, data, or
other system without proper authorization, including,
without limitation, (a) any attempt to access
any network, service, data, or other system that
such USER is not authorized to access; (b) any
attempt to probe, scan, or test the vulnerability
of any network, service, or system without proper
authorization; (c) any attempt to breach any
security or authentication measures; (d) any
attempt to monitor data or traffic on any network
or system without proper authorization; (e) any
attempt to interfere with service to any User,
host, or network, including, without limitation,
by means of overloading, mailbombing, flooding,
crushing, or any denial of service attacks; (f)
any attempt to forge any TCP/IP packet header
or any part of the header information in an e-mail
message or a newsgroup posting; or (g) any attempt
to utilize another USERS's account name without
proper authorization.
Spamming
USERS may not use EVISIONS services or websites
or network to transmit any unsolicited commercial
or unsolicited bulk e-mail messages (commonly
known as "spam"). For purposes of this legal
information, an e-mail message shall be deemed
to be unsolicited if (a) it is sent to a recipient
(b) who has not expressly requested or invited
it, (c) with whom the sender does not have an
existing personal or business relationship, or
(a) who has requested that the sender not send
it any further e-mail messages or (b) such e-mail
message is considered to be unsolicited under
any applicable local, state, or federal law or
regulation.
USERS may not use EVISIONS services or websites
or network to transmit any unsolicited commercial
or unsolicited bulk messages via USNET or USERGROUP
or MESSAGE BOARDS or FORUMS (commonly known as "spam").
For purposes of this legal information, an message
shall be deemed to be unsolicited if (a) it is
posted (b) on any forums who have not requested
or invited it, (c) with whom the sender does
not have an existing personal or business relationship,
or (a) who has requested that the sender not
send it any further forums or (b) such postings
are considered to be unsolicited under any applicable
local, state, or federal law or regulation.
Consequences, Violations of Legal and
Modifications
If EVISIONS determines that a USER has violated
any of the terms of this LEGAL page, EVISIONS
shall have the right in its sole discretion (a)
to demand immediate removal of the violating
material and/or (b) to terminate or to suspend
such USER's services. EVISIONS may involve and
shall cooperate with law enforcement authorities
if criminal activity is suspected. In addition,
USERS who violate this LEGAL page may be subject
to civil or criminal liability in the State Of
Arizona. EVISIONS shall not be liable for any
damages suffered by any USER or third party resulting
directly or indirectly from any actions taken
by EVISIONS pursuant to this LEGAL page.
Violations or potential violations of any part
of our legal page may be reported to EVISIONS
at abuse@evisionsmarketing.
EVISIONS reserves the right to modify this legal
page from time to time without notice in EVISIONS
sole discretion. Such modifications shall be
effective when posted.
